Procedures for Registering copyrights in Vietnam

 

Registration of copyright and related rights means the filing of an application by an author, copyright owner or related right owner with the competent State body in order to record information on the author, the work, the copyright owner and the related right owner.

(Clause 1, Article 49 Law 50/2005 on Intellectual Property (amended by Law 36/2009, Law 42/2019 and Law 07/2022))

Legal basis:

– Law 50/2005/QH11 on Intellectual Property and Amendments,

– Decree 17/2023/ND-CP on Copyright,

– Circular 08/TT-BVHTTDL on Copyright (Regulations on forms in copyright and related rights registration activities, 2023).

1. Applications for registration:

1.1. A written declaration for registration of copyright;

1.2. Copies of the works (including also e-copies).

1.3. A power of attorney.

1.4. Documents proving the rights holder:

– Document proving personal identification, for individuals.

– Document proving the legal status, for organizations.

– Document proving that the applicant is the rights to holder as a result of assignment of the task of creating works within a unit or an organization (the original or a notarized or certified copy).

– Document proving that the applicant is the rights to holder as a result of entry into a contract on performance of the task of creating works (the original or a notarized or certified copy).

– Document proving that the applicant is the rights holder as a result of inheritance.

– Document proving that the applicant is the rights holder as a result of transfer of rights.

1.5. The written consent of the co-authors, co-holders (if any).

– The written commitment on creation on his/her own of the work (if the author is not concurrently the copyright holder).

– In case the personal image of another person is used in the work, the written consent of such person.

2. Time-limit for granting Certificate: 15 working days from the receipt of the valid application.
3. Competent authority: Copyright Office of Vietnam.
