Tiếng Việt(1) Under Article 58 of Vietnam IP Law:
(i) An invention shall be protected by mode of grant of invention patent when it satisfies the following conditions:
– Being novel;
– Involving an inventive step;
– Being susceptible of industrial application.
(ii) Unless it is a common knowledge, an invention shall be protected by mode of grant of utility solution patent when it satisfies the following conditions:
– Being novel;
– Being susceptible of industrial application.
(2) The period of protection is 20 years for invention patents from the filing date, while it is 10 years for utility solution patents for from the filing date.
(3) The deadline for filing a request for examination in a patent application for invention is 42 months from the earliest priority date, while it is 36 months for a patent application for utility solution.
